Terms of Service
Effective date: 23 September 2026
These Terms of Service (“Terms”) govern your access to and use of QYQO’s AI creative platform, websites, applications and related services (the “Services”). QYQO is operated by an independent operator established in France (“QYQO”, “we”, “us” or “our”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use QYQO.
Eligibility and user accounts
You must be at least 16 years old, or the minimum age required to consent to digital services in your country, to create an account. If you are under the age of legal majority, a parent or legal guardian must review and accept these Terms where required by law.
You must provide accurate information, keep your authentication methods secure and promptly notify us of unauthorised access. You are responsible for activity conducted through your account. You may not sell, transfer or share an account in a way that compromises its security or circumvents limits.
QYQO’s services
QYQO provides tools for creating, transforming, editing, organising, storing, downloading and sharing images, videos, audio and related creative materials using artificial intelligence and device-based media processing. Features may include different models, styles, projects, generation history, private libraries and background generation jobs. Results vary by prompt, source material, model and technical conditions, and no particular output is guaranteed.
Your content and permissions
“Your Content” means photos, videos, audio, prompts, text, reference materials and other content you upload or submit. You retain any rights you hold in Your Content. You grant QYQO a worldwide, non-exclusive, limited licence to host, reproduce, process, modify and transmit Your Content solely as necessary to provide, secure and improve the Services, comply with law and enforce these Terms.
You represent that you own or have all rights, permissions, licences and consents needed to upload and process Your Content. This includes appropriate consent from identifiable people and rights to any image, voice, likeness, music, artwork, trademark or other protected material. You must not use QYQO to violate privacy, publicity, intellectual-property or other rights.
AI-generated content
Subject to applicable law and third-party rights, QYQO does not claim ownership of content generated specifically for you through the Services. You may use and commercialise generated content to the extent permitted by law and any model- or feature-specific terms displayed to you.
AI outputs may be inaccurate, unexpected, similar to content generated for others, or may contain artefacts. Outputs may not qualify for intellectual-property protection in every jurisdiction. You are responsible for reviewing results before using or publishing them and for obtaining any rights or clearances your intended use requires. Do not rely on generated content as professional, legal, medical, financial or factual advice.
Prohibited and abusive uses
You may not use QYQO to create, upload, request, distribute or facilitate:
- illegal content or conduct, fraud, scams, phishing, malware or security attacks;
- child sexual abuse material, sexual exploitation of minors or content sexualising minors;
- non-consensual intimate imagery, sexual deepfakes, stalking, doxxing or targeted harassment;
- content that unlawfully infringes intellectual property, privacy, publicity or data rights;
- deceptive impersonation, identity fraud or misleading synthetic media intended to cause harm;
- credible threats, incitement to violence, terrorist activity or instructions for serious harm;
- discrimination or abuse directed at protected groups where prohibited by law; or
- attempts to bypass safeguards, rate limits, access controls, credits or account restrictions.
You also may not scrape, reverse engineer, disrupt, overload, resell or provide unauthorised access to the Services. We may use automated and human review to investigate suspected violations where permitted by law.
Intellectual property
QYQO and its licensors retain all rights in the Services, including software, product design, branding, logos, text, interfaces and underlying technology. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose. They do not grant you ownership of QYQO’s technology or brand. Feedback you voluntarily provide may be used by QYQO without restriction or payment, provided it does not identify you publicly without permission.
Credits, payments and refunds
Some features consume credits based on the selected tool, model or requested output. Credit costs may differ between image, video, audio and other services and will be shown or made available before use where practical. Promotional or free credits have no cash value, are non-transferable and may expire where clearly disclosed.
If QYQO introduces paid credits or subscriptions, prices, taxes, billing intervals and renewal terms will be shown before purchase. Except where required by law or stated at purchase, completed or consumed digital services are non-refundable. Credits reserved for a generation that fails because of a QYQO or provider error may be restored automatically. Nothing in these Terms limits mandatory consumer cancellation or refund rights under applicable law.
Privacy
Our Privacy Policy explains how we process personal data, uploaded media and generated content. By using QYQO, you acknowledge those practices.
Service availability and changes
We aim to keep QYQO available and reliable, but the Services may be interrupted, delayed or limited by maintenance, demand, third-party providers, model availability, regional restrictions or events beyond our control. We may add, change, suspend or discontinue features and may set usage, storage or generation limits. Where a material change adversely affects a paid service, we will provide notice or remedies as required by law.
Suspension and termination
You may stop using QYQO at any time and may request account deletion. We may restrict, suspend or terminate access if we reasonably believe you have violated these Terms, created risk or harm, failed to pay amounts due, or if required by law. Where appropriate, we will provide notice and an opportunity to appeal.
On termination, your right to use the Services ends. Provisions that by their nature should survive will remain effective, including provisions concerning ownership, payment obligations, disclaimers, liability and disputes.
Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available”. QYQO disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. We do not warrant that outputs will be accurate, unique, lawful for every intended use or free of third-party claims. These disclaimers do not exclude warranties or consumer protections that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, QYQO will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or business opportunity, arising from use of the Services. QYQO’s aggregate liability for claims relating to the Services will not exceed the greater of the amount you paid QYQO during the 12 months before the event giving rise to the claim or €100.
This limitation does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, liability that cannot be limited by law, or mandatory consumer rights.
Governing law and disputes
These Terms are governed by French law, without prejudice to mandatory protections available in your country of residence. Courts in France will have jurisdiction, except where applicable consumer law allows or requires you to bring a claim in another court. Before filing a claim, please contact us so we can try to resolve the issue informally. Consumers in the European Union may also have access to an independent consumer mediator where required by law.
Changes to these Terms
We may update these Terms to reflect new features, provider requirements, legal obligations or changes to QYQO. We will post the updated Terms and revise the effective date. If a change is material, we will provide reasonable additional notice where required. Continued use after the effective date means you accept the updated Terms; if you do not agree, you must stop using the Services.
